Wisconsin man to plea or stand trial in CSC case
ESCANABA – A Wisconsin man charged with sexually assaulting a girl in 2011 has until Friday to make a plea or the case will be scheduled to go to trial.
Justin Dylan Smith, 28, of Sheboygan, Wis., was arrested last fall for allegedly sexually assaulting a minor under the age of 13 years. The first-degree criminal sexual conduct charge stems from incidents in Masonville Township in November 2011.
The case was suppressed from the media and public at the district court level. Last month, the case was bound over to Delta County Circuit Court where a pretrial conference is scheduled for Feb. 13. At that time, a date may be scheduled for a plea hearing or a trial.
Smith is charged with first-degree criminal sexual conduct for engaging in sexual penetration of a victim under the age of 13 years. The felony carries a maximum sentence of life in prison.
Smith is also charged with a second count of first-degree criminal sexual conduct of a person under the age of 13 years, with a notice of the sexual offender registration act.
Smith remains lodged in the county jail in lieu of a $50,000 cash bond. He was ordered by the court not to have contact with any minor.
