Man sent to prison for CSC
ESCANABA – A Wisconsin man, recently convicted of sexually assaulting a young girl in Masonville Township in 2011, was sentenced Monday to spend up to 40 years in prison. The judgment was handed down in Delta County Circuit Court.
Following a three-day jury trial in May, Justin Dylan Smith, 29, of Sheboygan, Wis., was found guilty of first-degree criminal sexual conduct.
On Monday, Judge Stephen Davis sentenced Smith to 25-40 years in prison. Davis also ruled the defendant pay $198 in fines and costs. He was given credit for 213 days already served in jail. He was ordered to have no contact with the victim or any minors.
Smith was arrested and charged with two counts of first-degree criminal sexual conduct for allegedly engaging in sexual penetration of a victim under the age of 13 years. The charges stem from incidents in Rapid River in November 2011 involving an 11-year-old female.
On May 24, after deliberating for less than two hours, a jury found Smith guilty of one count and not guilty of the other count.
