Esky man faces CSC charge

ESCANABA – A 76-year-old Escanaba man will be sentenced this month on a criminal sexual conduct charge for actions against an incapacitated victim, according to Delta County Circuit Court records.

Thomas Fudala, of 5387 18th Road, Lot 2, Escanaba, was arrested earlier this year in connection with an alleged sexual assault in Wells Township on May 18, 2014.

He was charged with second-degree criminal sexual conduct involving a relationship with a mentally-disabled female victim. The felony carries a maximum sentencing of 15 years in prison. He was lodged in the county jail in lieu of a $25,000 cash bond.

Fudala later pleaded to fourth-degree criminal sexual conduct involving an incapacitated victim. The high-court misdemeanor carries a maximum sentencing of two years in jail and a $500 fine. The second-degree criminal sexual conduct charge was dismissed.

Prior to Fudala’s case being bound over to circuit court, the case was suppressed to the public and the media at the district court level.

Fudala remains lodged in jail. He is scheduled to be sentenced in circuit court on July 24.
