Man to be sentenced in August

ESCANABA – A Rapid River man will be sentenced next month on several counts related to indecent exposure incidents and using a telephone and a computer for malicious purposes in Delta County.

Thomas Anthony LaVigne, 29, appeared in Delta County Circuit Court on Friday when he pleaded to eight charges relating to indecent behavior from 2012 to 2014.

LaVigne was arrested in March when police tracked him at his home after receiving a detailed description of his vehicle following the report of a man exposing himself to a female that day.

On Friday, LaVigne admitted to committing indecent exposure of his genitals on five occasions involving five females including one minor.

He also admitted to being a habitual offender for his conviction of larceny in a building in 2006. The previous conviction enhances his maximum sentencings by one and a half times.

In addition, LaVigne pleaded no contest to anonymously making more than 50 phone calls to one female and three phone calls to a minor female and asking them pornographic-related questions.

LaVigne will be sentenced as a habitual offender on Aug. 29 on one felony count of gross indecency which has a maximum sentencing of seven and a half years, and four counts of aggravated indecent exposure, each punishable by up to three years.

He will also be sentenced for using a computer to commit a crime, punishable by up to six years in prison, and two counts of malicious use of telephone services, each punishable by up to six months in jail.

In exchange for Friday’s pleas, one count of aggravated indecent exposure by a sexually-delinquent person (a life felony) was dismissed along with other misdemeanors.
